TrafCam Terms and Conditions of Sale

Definitions

Application

This agreement applies to this sale, and to all statements made by TrafCam Ltd in brochures, price lists, advertisements, quotations, whether on the Internet, verbally or in printed form. Any variations to this must be confirmed by TrafCam Ltd in writing. Placing your order means that you accept this agreement.

Orders and Contract

Orders may be received in writing, by internet, telephone or fax, but are only binding when accepted by TrafCam Ltd in a written order confirmation.

Price and Payment Terms

All payments must be received prior to supply of products.

For credit card payments, these will be processed on the next working day after they are received, unless we are unable to do so for reasons beyond our control. We will not take money from your credit card until we are in a position to provide the item(s) you have ordered.

For on-line credit card payments, these are processed by SecPay and not directly by ourselves. The subscription is activated as soon as the SecPay web site informs our server that the payment has successfully been processed.

We do not store your credit card information. On-line orders are processed by SecPay who have their own security arrangements. Other orders placed by fax, post or email are processed by us directly and the card data is not retained electronically.

For cheque payments, goods or software will be shipped or activated once the cheque has cleared and the funds are in our account.

For PayPal payments, goods or software will be shipped or activated once we have received confirmation from PayPal that payment has been made.

Warranty

All third-party hardware or software is warranted by its manufacturer and you may be referred directly to that manufacturer for warranty claims.

TrafCam is guaranteed to operate as designed. No warranty is offered as to the quality or level of completeness of the TrafCam camera database.

We do not offer a warranty for:

Software Licence

TrafCam includes a licence to run the camera warning software on 1 (one) device at any one time. You agree not to attempt to reverse-engineer either the software or camera database. When the TrafCam subscription has expired, the software will cease to operate.

Consumer Rights

If you are a consumer you may cancel your purchase at any time within seven days of receipt without cause and receive a refund of the price paid, less a re-stocking charge of 15%. To do this you must inform TrafCam Ltd in writing, and you must return the products immediately in the same condition that you received them, and at your own cost and risk.

Once downloaded from the web site, the software cannot be returned for refund. Any statutory consumer rights are unaffacted by this agreement. This does not apply to any business customer or user.

Promotion Codes

From time to time we may offer a promotion code which could offer TrafCam products for sale at reduced prices for a limited or unlimited period of time. If the promotion code is not entered during the "subscription application" process then any discount provided by the promotion will not be applied.

The expiry of the promotion refers to the date that the payment is processed, not the date that the subscription is first applied for. One specific exception to this is with regard to payment methods, where if the customer applies for a subscription using a payment method which requires manual processing, and the application is made outside of office hours, and the next time that it can be processed is after the expiry of the promotion, then the special price would be honoured.

Software downloads

All software downloads are checked for the presence of virus or other malware but you are responsible for having suitable protection on your own PC. TrafCam Ltd will accept no liability for any issues arising from this.

TrafCam for TomTom Go, free trial

TrafCam can be installed at no cost, for a limited trial period, on a TomTom Go device. Each device can only install the trial software once, and when the trial period has elapsed the software will no longer operate. Once the trial period has expired the customer can choose to pay the subscription fee and convert to a full subscription, or to remove the software from their device.

Jurisdiction

English Law and the exclusive court jurisdiction of the English courts will apply to this agreement.

Miscellaneous

If any part of this agreement is found to be invalid or unenforceable by a court, the rest is unaffected.
